Farewell, but not Goodbye

As my semester-long study of disability rights on the global agenda comes to a close, I look back at the whirlwind of study, pondering, and production with vigor and pride. I ended my study with a class presentation highlighting the evolution and path to the successful adoption and entry into force of the Convention on the Rights of Persons with Disabilities (CRPD). The presentation concluded with lessons from disability rights that may be applied to the global norm building campaign of the Campaign for Innocent Civilians in Conflict (CIVIC), the organization I have also been studying all semester.

From here, my colleagues and I turned our full attention to CIVIC. We completely immersed ourselves in the production of a strategy paper and Power Point presentation which we presented to CIVIC just yesterday. After our presentation, we spent over an hour discussing the campaign and getting to know the staff at CIVIC. The briefing was a fantastic and inspiring success! It is really so amazing and inspiring to contemplate what CIVIC has accomplished in such a short time with a staff of 4-5 incredibly motivated and intelligent people. I am very honored to have had the opportunity to work with them. You can see pictures from the event on the course blog, What Should CIVIC Do?. The post is titled "BREAKING NEWS...".

I titled this post, "Farewell, but not Goodbye" because although I won't be posting on disability rights any longer, the work of CIVIC - and any influence my class had on that - will continue. I also expect my blogging will continue as I develop my personal site at thoughtsbytillmann.blogspot.com

Thoughts on Hubert and Disability Rights

Hubert's model (2007) resonates with the disability rights movement and the most recent global campaign in particular. Like many of Hubert's more successful cases, early stages of the campaign were characterized by minimal cooperation by nations as a whole. However, many individuals in positions of national or international power were important. I've already mentioned Mr. Mansur R. Kikhia of Libya (see post below). In addition, Rehabilitation International (RI) President O’Reilly of Ireland presented the Charter for the Third Millenium to fellow countrywoman Mary Robinson, then the UN High Commissioner for Human Rights, and the Chair of the UN Commission on Human Rights, Ambassador Anderson (Groce 2002).

Hubert (2007) mentions close collaboration between civil society and governments is important for mobilizing political will and monitoring implementation. I'm still looking into this and will probably be focusing on RI, Disabled Peoples International (DPI), and the International Disability Alliance (IDA). IDA is the “main international disability organizations having consultative status with the U.N” (Groce 2002, 95). Either RI or the IDA has a big monitoring body for disability rights around the world, I don't remember which off-hand.

Role of Governments in Disability Rights Movement

The following are some quick notes about governments as entrepreneurs in disability rights.

1) In 2001, the Third Committee of the UN General Assembly adopted a resolution titled Comprehensive and Integral International Convention on Protection and Promotion of the Rights and Dignity of Persons with Disability. It uses a human rights approach and recommends the formation of two UN Ad Hoc Committees: One for the development of a convention and the other for a convention including a strong statement about discrimination (Kanter 2003). Ireland and Mexico took leading roles in the committees.

2) Strong links between Rehabilitation International (RI), one of the most important NGO entrepreneurs in disability rights, and national governments may be an indicator of entrepreneurship on the part of the country. After RI restructured in the early-mid 70’s, national governments and organizations were more included. As a result, certain countries began funding RI. Germany was among the first (RI’s President during reconstruction was Kurt Jochheim of Germany). Canada followed. (Groce, 2002)

3) It was a UN delegate from Libya, Mr. Mansur R. Kikhia, that suggested the timing may be right for the United Nations to have an International Year of Disabled Persons (IYDP) (Groce 2002, 74). Since the IYDP and the International Decade of Disabled Persons that followed was so instrumental in the movement, Mr. Kikhia and therefore Kenya, are one entrepreneur.

4) From 2002-2005, countries with "experienced disabled politicians and lawyers on their delegations were being looked to for leadership in both substance and suasion" (Duncan & Geagan 2005, ii). I could not find information beyond that, yet it still provides an important clue to the agenda-setting process in the disability rights movement.

5) The use of the American with Disabilities act as a model for constructing and evaluating disability policies means the United States plays an important role (Cook, 2005). However, it is probably better termed "capacity-builder" than "entrepreneur".

The United Nations and Disability Rights

The history and role of the United Nations (UN) and its agencies in disability rights is long and varied. A few examples followed by a timeline will illustrate this relationship. Together, the examples and timeline address the following questions: Which UN agencies have been involved in disability rights?, At what point did they become involved and why?, What was the nature of their involvement?, and How did the UN affect the nature of the issue and of the agenda-setting process?.

The United Nations (UN) as a whole has been involved in disability rights since the 1970's. However, the nature of their involvement often lagged behind the conception of disability rights promoted by the disability rights community. This was primarily manifested by using anything other than a human rights model to characterize disability rights in conventions, resolutions, and other documents. Around 1993, this began to change and the UN was eventually seen as instrumental in identifying disability rights as a human rights issue (Kanter 2003).

Support for a disability-specific convention has also increased over time. Among many reasons for increasing support, the ratification of a convention of disability rights introduces a new level of accountability to protect disabled people from harm (Kanter 2003). Another reason for support is that outside of the disability rights community, many international governmental and non-governmental organizations continued to marginalize disability issues. Examples include using the medical model in lieu of a human rights frame and failing to solicit input from the disability rights community. A UN convention on disability rights was seen as a way to combat this (Kanter 2003). Finally, a UN convention could improve monitoring and enforcement regarding disability issues (Kanter 2003).

Moving on to UN agencies, the World Health Organization (WHO), UNICEF, World Bank, and UNESCO have all been involved in disability rights. It is not clear when the WHO became involved. However, they mimic the frame supported by the disability rights community and the UN Convention (disability arises both from the individual and interaction with the individual's environment). According to the WHO's 2006-2011 Action Plan on Disability and Rehabilitation, various factors including increased chronic illness, prolonged average lifespan, and poverty are placing enormous demands on health and rehabilitation services.

It is also not clear when UNICEF became involved. In a press release regarding the Convention, they praise the progress and note one of their first priorities will be "working with UN and civil society partners to create awareness and empower children, parent associations and other organizations to use the Convention as an advocacy tool".

The World Bank's Bangladesh Disability and Children at Risk seeks to promote equity and social inclusion by expanding social care services to those with disabilities and vulnerable children. It was approved July 1 2008 and runs through Dec 31 2014 with a budget of 35 million dollars. Another program, the PK Earthquake Disability, will improve the quality of life for disabled people and their families afflicted by the Oct 8 2005 earthquake. The project was approved May 21 2007 with a budget of 5 million dollars and will run through Dec 31 2008.

UNESCO published a report in 1995 titled "Overcoming Obstacles to the Integration of Disabled People" that provided, among other things, updated statistics on the number and location of the world's disabled (Charlton 1998, p. 8) More recently, UNESCO produced a video and press release to raise awareness about the recently adopted Convention. It focuses specifically on the importance of educating disabled children.

The timeline below provides further detail on the history and role of the UN and its agencies in disability rights.

1971: The United Nations (UN) adopts its first international human rights instrument specifically addressing the right of people with disabilities, the Declaration on the Rights of Mentally Retarded Persons (Kanter 2003). The declaration relies on a medical, instead of a human rights model (Kanter 2003).

1975: In international law, the Declaration of Rights of Disabled Persons affirms the right to the same civil and political rights as the non-disabled for persons with disabilities (Kanter 2003).

1982: A series of UN resolutions culminates in the World Programme on Action Concerning Disabled Persons.

1987: Global Meeting of Experts to review the Implementation of the World Programme of Action concerning Disabled Persons recommends drafting of an international convention on the elimination of all forms of discrimination against persons with disabilities by conference of UN General Assembly. Draft agreements were prepared but rejected due to disinterest and treaty fatigue (White Paper, 68).

1993: UN adopts Standard Rules on Equalization of People with Disabilities. It promotes the "view of equal rights protections" instead of a social welfare approach (Kanter 2003, 504). A Special Rapporteur is appointed and mandated to report on the status of disabled persons in the world to the UN Commission on Social Development (Kanter 2003). The UN General Assembly used language from disabled peoples' organizations for some of their definitions (Priestley 1999, p. 8). It also promoted participation from the disabled and their families in the construction of policies and services that concern them (Priestley 1999, p. 159). The Standard Rules therefore made a clear link between equalized opportunities and participatory citizenship in states (Priestly 1999, p. 210).

1994: UN Committee on Economic, Social, and Cultural Rights issues General Comment to aid interpretation of International Convention on Economic, Social, and Cultural Rights for persons with disabilities. A human rights approach is adopted.

Media Coverage of Disability Rights Over Time

The graph above depicts the results of a Lexis Nexis search for "disability rights" within major U.S. and World publications, major world publications (non-English), news wire services, TV and radio broadcasts, and blogs for every year from 1976 to 2008. From the mid 1980's, the prevalence of disability rights in media publications begins to rise. 1997-1999 mark a sharp increase in newspapers, newswires, and press releases. At this time, the British government established a Disability Rights Commission with a Taskforce, the Supreme Court of Canada ruled unanimously for equal access and equal benefit, and activism and awareness was on the rise in the United States. The peak of magazine and journal articles and news transcripts in 2005 is most likely due to the UN's adoption of the Convention on the Rights of Persons with Disabilities (CRPD).

Although these changes are heartening, a causal relationship between this increased media attention and the disability rights agenda is unclear. Did positive action spur media attention? Or did media attention help galvanize and popularize the global disability rights movement? Increasing media coverage in the mid 1980's suggests a possible positive effect on the 1990 passage of the Americans with Disabilities Act. It is hard to say whether this affects the global agenda. On the one hand, trends often follow the United States. The Lexis Nexis search shows predominantly American publications in the mid 80's with increasing presence over the next decade. On the other hand, the period 1997-1999 is dominated by news from the U.K. and Canada in the first few pages of search results.

One possible explanation is activity in the United States up to and after the ADA was passed aided international attention and action on the same issues. This action exploded from 1997-1999, with the reporting and/or prodding of newspapers, newswires, and press releases, and maintained momentum through the 2006 adoption of the CRPD. High numbers of news transcripts, journals, and magazines from 2006-2007 are indicative of increased reporting due to major headlines, i.e. the adoption and entry into force of the CRPD.

Newspapers, newswires, magazines, journals, and news transcripts are not the only media publications the Lexis Nexis search turned up. The presence of legislative histories, legal news, and newsletters beginning in the mid 90's (see graph below) as well as country and region reports, bills and bill tracking, and statistics, beginning around 2001 (see graph below) is strongly indicative of increasing salience of disability rights. Legal news as well as bills and bill tracking peak in 2005, just when the CRPD is being finalized. Legislative histories peak in 2004, when the Convention's articles are being written. Newsletters peak just before this in 2002-2003, just when a public relations push may have been necessary. Statistics and country and region reports generally show a steady increase over time. Interestingly, the number of blogs cited in Lexis Nexis (not shown) increased from 6 in 2006 to 85 in 2007 and 88 in 2008. This may indicate increasing salience.


The role of media coverage and the global disability rights movement is not unilateral. At times, it appears to respond to actions by organizations and governments, such as increasing coverage during the mid 80's. At others, it appears media coverage may increase or sustain the attention of organizations and government, such as the high rates of coverage occurring in present day. A discernible pattern is not yet apparent.

Timeline 1981-present

1981: International Year of Disabled Persons. Disabled Peoples' International founded and granted Special Consultative Status by UN.

1983-1992: International Decade of Disabled Persons

1987: Global Meeting of Experts to review the Implementation of the World Programme of Action concerning Disabled Persons recommends drafting of an international convention on the elimination of all forms of discrimination against persons with disabilities by conference of UN General Assembly. Draft agreements were prepared but rejected due to disinterest and treaty fatigue (White Paper, 68).

1990: United States passes Americans with Disabilities Act and President George H.W. Bush signs into law.
1993: Disabled persons part and parcel of modern HR int’l law (Vienna Declaration of the 1993 World Conference on Human Rights), stated in White Paper (p. 53).

1993: Mental Disability Rights International established. Since then, they have “advised US and international agencies, including the U.S. Department of State, UNICEF, the World Health Organization, the UN Special Rapporteur on Disability, and the U.S. National Council on Disability” and “advocated for the creation and resolution of the United Nations Convention on the Rights of Persons with Disabilities.” On current board of advisors is Reed Brody of Human Rights Watch (HRW).

1995: DPI Women’s Programme “initiated a campaign to voice their concerns regarding the increasing use of eugenic health policies and practices, such as forced abortion and sterilization, as a part of their participation in the Beijing process” (White Paper, p. 43)

1999: Hong Kong’s Interregional Seminar on International Standards on Disability doctrine “supports the use of a fully participatory approach to developing a comprehensive treaty on the human rights of people with disabilities 10.” (White Paper, p. 52) In other words, disability groups should be involved.

1999
: ACLU position paper on Disability Rights.

2002: Disability rights advocacy community is inexperienced and is not applying appropriate pressure to keep issue on agenda. September 25, 2008: President Bush signs S. 3406, the “ADA Amendments Act of 2008” into law. It “clarifies and broadens the definition of disability and expands the population eligible for protections under the Americans with Disabilities act of 1990.”

December 3, 2008: International Day of Persons with Disabilities. Theme is “Convention on the Rights of Persons with Disabilities: Dignity and justice for all of us.”

Ambiguous Gatekeepers and a Potential Entrepreneur

Representing more than 600 million people worldwide and composed of eight large member organizations including (DPI) and Rehabilitation International (RI), the International Disability Alliance (IDA) is the foremost representative of disabled persons worldwide. Although I suspect IDA is the political entrepreneur most responsible for positioning disability rights on the global stage, they could also be seen as the gatekeeper. I was unable to determine the precise role of IDA because their website is currently under construction and limited information is available. In light of this, a discussion of DPI as a political entrepreneur follows.

The same year (2002) the U.S. National Council on Disability came out with a White Paper describing several factors within the disability rights and international human rights communities that led to a decline in salience and visibility of disability rights as a global issue, DPI convened its 6th World Assembly in Sapporo, Japan and produced the Sapporo Declaration.

Where the White Paper uses literature and precedent to support the need for equal rights (p. 53), a compliance mechanism (p. 55), and sees treaty adoption as securing a place for disability rights in the major human rights organizations (p. 61), the Sapporo Declaration demands
"a specific international human rights convention that is reflective on the full range of civil, political, economic, social and cultural rights and that includes a strong convention-monitoring mechanism informed by the unique perspective of people with disabilities to ensure credibility, legitimacy and efficacy of the convention; Disabled people demand a voice of our own in the development of this instrument. We must be consulted at all levels on all matters that concern us" (p. 7).
The White Paper provides a rationale for treaty adoption by stating "the advantage of a treaty setting forth obligations on the rights of people with disabilities is that it will establish concrete obligations for government conduct thatwhich specifically address disability" (p. 62). The Sapporo Declaration simply urges "all UN member states to support the formulation and adoption of this convention" (p. 8). Both the clarity and strength of language in the Sapporo Declaration is indicative of political entrepreneurship. DPI has identified a lack of equal rights for disabled people as a problem and provided a solution to the problem. Next, DPI has to "shop around" to prick the interest of a gatekeeper.

The most obvious gatekeeper is IDA. Not only do they represent eight major disability organzations worldwide, but they have connections to the UN and other, larger gatekeepers. They aim to be a "spokesperson for the international disability movement in global policy matters" and facilitate "co-operation and exchanges of information among international disability organisations." Their first goal is "To identify common positions on disability issues and to lobby UN agencies together on those to which there is agreement." Certainly a convention on the rights of disabled persons fits this criteria.

However, other organizations must be considered. DPI maintains official relations with UNESCO and the World Bank. In fact, the World Bank Group's advisor on Disability and Development (2001-present), Judy Heumann, is one of the co-founders (1983) and was a co-director (1983-1994) of the World Institute on Disability, an "internationally recognized public policy center by and for people with disabilities." Furthermore, the same year the White Paper was published and the Sapporo Declaration was created, a disability and development conference at the World Bank fostered the Global Partnership on Disability and Development (GPDD). At an International Conference on Disability and Development in 2004, Heumann describes GPDD as "a good example of an informal coalition, including the Bank and more than one hundred other organizations" and states their goal is to "build and disseminate good practices in order to help countries achieve the goals of access, inclusion, and poverty reduction of people with disabilities."

Given these relationships, it is possible the gatekeeper who adopted the issue is the World Bank or perhaps a combination of IDA, the World Bank, and UNESCO. I was not able to find specific evidence of DPI "pitching" their issue, so I have constructed a possible "adoption" situation given links between organization's webpages and Judy Heumann.

Finally, the disability rights community can be fractious. The White Paper identifies one of the risks in the treaty process as the "relative degree of consensus within the broad disability community as to the key elements of a coherent and focused international campaign" (p. 68). As the definition of disability broadens, the possibility of disagreement between and among sub-populations increases.

To conclude, the political entrepreneur in the disability rights movement is a well-organized, popular international disability organization (DPI/IDA) who most likely pitched its issue to a larger international disability organization (IDA/none) and/or the World Bank or UNESCO, who adopted the issue, resulting in proliferation on the world stage. Increasing momentum from 2002 to mid-2007 resulted in the UN's adoption of the Convention on the Rights of Persons with Disabilities and its Optional Protocol and its entry into force.
